(California Court of Appeal) – In a petition for writ of mandate by an insurer involved in underlying litigation for personal injury and wrongful death, the trial court’s denial of petitioner’s motion for summary judgment is reversed and the petition is granted where plaintiff’s efforts to pursue essentially a “bad faith” action as assignee of the insured must fail.
